Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Fitzyc for your use of fitzyc.com, our guides, food database, calculators, and the Fitzyc app (the “Services”).

By accessing or using the Services, you agree to these Terms, our Privacy Policy, and our Medical Disclaimer. If you do not agree, do not use the Services.

1. What Fitzyc is

Fitzyc is a health and wellness platform. The website offers educational articles, a food lookup, and calculators that produce general estimates (for example calories, BMI, protein, and water). The app lets you set goals and log meals, movement, sleep, habits, and weight.

Fitzyc is not a medical device, clinic, pharmacy, or healthcare provider. Content is for education and self-tracking. It does not diagnose, treat, cure, or prevent disease and does not replace advice from a qualified professional. Always speak with a doctor, dietitian, or other licensed clinician before changing diet, exercise, or medication — especially if you are pregnant, under 18, recovering from illness or surgery, or living with a medical condition.

2. Eligibility

You must be able to form a binding contract in your country. The website may be read by a general audience. App accounts are for users aged 16 or older. If you are between 16 and the age of majority where you live, you confirm that a parent or guardian agrees to these Terms. Do not create an account for a child under 13.

3. Accounts

You are responsible for the accuracy of the information you submit and for keeping your password confidential. Notify us at hello@fitzyc.com if you think someone has used your account without permission. We may refuse, suspend, or close an account if these Terms are broken or if we must do so for security or legal reasons.

4. Acceptable use

You agree not to:

  • use the Services for anything unlawful, harmful, or fraudulent;
  • upload malware or attempt to break, scrape at abusive volume, or reverse engineer the Services except where the law allows;
  • copy, sell, or misrepresent Fitzyc content as your own product or as clinical advice;
  • harass others or post content that is illegal, defamatory, or infringes someone else’s rights;
  • use the Services to make medical decisions for another person in a professional capacity unless you are separately licensed to do so — Fitzyc does not grant that licence.

5. Calculators, food data, and estimates

Calorie, BMI, BMR, protein, water, and similar tools use published population formulas and typical food composition figures. Results are approximate. Brands, recipes, cooking methods, and laboratory values differ. Food database entries are educational references, not a certified nutrition label for a specific product on your plate. You are responsible for how you use any number the Services show.

6. Your content

You keep ownership of the logs and text you enter. You give Fitzyc a limited licence to host, store, back up, and display that content so the Services work for you. You must have the right to submit what you enter. We may remove content that violates these Terms or the law.

7. Our content and marks

Articles, layout, calculators, graphics, the Fitzyc name, and the logo are owned by Fitzyc or our licensors. You may view and use them for your personal, non-commercial use. You may not copy the site or app for a competing service, republish our guides in bulk, or use our marks without written permission.

8. Third-party services

The website may load fonts or scripts from third-party CDNs. The app may rely on cloud hosting, sign-in, or device sensors (for example steps). Those providers are not under our full control. Links to other sites are for convenience only. We are not responsible for third-party content or practices.

9. Availability and changes

We aim to keep the Services available but do not guarantee uninterrupted access. Features, food entries, and formulas may change as we improve the product. We may add, pause, or retire parts of the Services. If we discontinue the app, we will try to give reasonable notice and, where practical, a way to export your data.

10. Paid features

The public website guides and calculators are free. If we later offer paid plans, prices, billing, and cancellation rules will be shown before you buy and will form part of these Terms for that purchase. Taxes may apply.

11. Disclaimer of warranties

The Services are provided “as is” and “as available”. To the fullest extent permitted by law, Fitzyc disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that estimates are accurate for you, that the Services will meet your health goals, or that they are error-free.

12. Limitation of liability

To the fullest extent permitted by law, Fitzyc and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services or reliance on any estimate or article. Our total liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us for the Services in the 12 months before the claim, or (b) USD 50, if you used only free features.

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence where such a limit is not allowed, or for fraud.

13. Indemnity

You agree to indemnify and hold Fitzyc harmless from claims, damages, and reasonable legal fees arising from your misuse of the Services, your content, or your breach of these Terms, except to the extent a claim is caused by our wilful misconduct.

14. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate access if you breach these Terms or if we shut down a Service. Sections that should survive (including intellectual property, disclaimers, liability limits, and governing law) remain in effect.

15. Changes to these Terms

We may update these Terms. The “Last updated” date will change. Continued use after the update means you accept the revised Terms, except where the law requires a different process. If you do not agree, stop using the Services and delete your account.

16. Governing law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules. Courts located in the Republic of Korea have exclusive jurisdiction over disputes, unless a mandatory consumer-protection law in your country gives you the right to bring a claim in your local courts.
